By accessing or using the GetUnburden platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you may not use the Service.
These Terms form a binding legal agreement between you and GetUnburden. By creating an account or accessing the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.
GetUnburden is not a substitute for professional medical advice, diagnosis, or treatment. The Service provides tools for self-reflection, journaling, mood tracking, and peer community support. It does not provide medical, psychiatric, or psychological services. You must be at least 18 years old to use GetUnburden. By registering, you represent and warrant that you meet this requirement. The Service is intended for medical professionals ("medicos") and is invite-only. You must have a valid invite code to register.
When you register, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised use of your account at support@getunburden.com.
You agree not to misuse the Service. Prohibited conduct includes:
We reserve the right to remove any content and suspend or terminate accounts that violate these provisions.
You retain ownership of any content you submit, post, or display on the Service ("User Content"). By submitting User Content, you grant GetUnburden a non-exclusive, worldwide, royalty-free, sub-licensable licence to use, reproduce, modify, adapt, publish, and display such User Content solely for the purpose of operating, providing, and improving the Service. This licence ends when you delete your content or your account, except to the extent your content has been shared with others (e.g., community replies) and removing it would impair their experience.
You represent and warrant that your User Content does not violate any third-party rights (including copyright, trademark, or privacy rights) and complies with these Terms.
Your use of the Service is governed by our Privacy Policy, which explains how we collect, use, share, and protect your personal data. By using the Service, you consent to the practices described in the Privacy Policy.
The Service, its design, software, text, graphics, logos, and all content not submitted by users are the property of GetUnburden or its licensors and are protected by Indian and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written permission. Nothing in these Terms grants you any right to use the GetUnburden name, logo, or trademarks.
The Service may contain links to third-party websites or services that are not owned or controlled by GetUnburden. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites. You access these at your own risk and should review their terms and policies.
We respect the intellectual property rights of others. If you believe that any content on the Service infringes your copyright, please provide a notice to support@getunburden.com with the following:
We will respond to valid notices and may remove or disable access to infringing content. Repeated infringement may result in account termination.
We may suspend or terminate your account at any time, without prior notice, if:
You may terminate your account at any time from your profile settings. Upon termination, your right to use the Service ceases immediately. Sections 8 (Intellectual Property), 12 (Disclaimers), 13 (Limitation of Liability), 14 (Indemnification), 16 (Dispute Resolution), and 17 (General) survive termination.
Medical Disclaimer: As stated in Section 2, GetUnburden does not provide medical, psychiatric, or psychological services. The tools and community are for informational and support purposes only.
Service Provided "As Is": The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or availability.
No Guarantee of Accuracy: We do not warrant that the Service will be uninterrupted, error-free, secure, or that defects will be corrected. We are not responsible for any content posted by users or for any actions taken based on content on the Service.
To the maximum extent permitted by applicable law, GetUnburden, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, personal injury, or medical outcomes arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the greater of INR 1,000 or the amount you have paid us in the 12 months preceding the claim.
You agree to indemnify, defend, and hold harmless GetUnburden, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:
We may modify these Terms at any time. If we make material changes, we will notify you via email and/or a prominent notice on the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date of the changes constitutes your acceptance of the modified Terms. If you do not agree with the changes, you must stop using the Service and delete your account before the effective date.
Governing Law: These Terms are governed by the laws of India, without regard to its conflict-of-law provisions.
Grievance Redressal: If you have a complaint regarding the Service, user data, or content on the platform, you may contact our Grievance Officer at grievance@getunburden.com. We acknowledge all complaints within 24 hours and resolve them within 15 days. For full details, see Section 16 of our Privacy Policy.
Informal Resolution: Before filing any claim, you agree to attempt to resolve the dispute informally by contacting us at support@getunburden.com. We will attempt to resolve the dispute within 30 days.
Arbitration: If the dispute cannot be resolved informally, any dispute arising out of or relating to these Terms shall be finally settled by binding arbitration in accordance with the Arbitration and Conciliation Act, 1996 (India). The arbitration shall be conducted in English in Jodhpur, Rajasthan, India, by a single arbitrator appointed by mutual agreement. The arbitrator's award shall be final and binding.
Class Action Waiver: Any dispute resolution proceeding shall be conducted only on an individual basis and not as a class, consolidated, or representative action.
Jurisdiction: For any claims that are not subject to arbitration, the courts in Jodhpur, Rajasthan, India shall have exclusive jurisdiction.
Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and GetUnburden regarding the Service and supersede any prior agreements or understandings.
Waiver: Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms freely.

GetUnburden is an intermediary under the Information Technology Act, 2000 and complies with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.
